Hereinafter referred to as “Buyer” . Buyer voluntarily entered into and agreed to all terms stated in this contract as witnessed by their signatures below.

Hereinafter referred to as “Puppy”
This contract applies to the original puppy and original buyer only and is nontransferable to a second party. No replacement puppy will be given if Puppy has been bred, neutered or spayed outside of the limitations of this contract. Buyer is responsible for transportation costs to and from Hidden Cedars AKC Mini Dachshunds on original and any replacement puppy.
As of the date of this agreement Puppy is in good health and free of communicable diseases. The buyer has 48 hours in which to have puppy examined by a veterinarian and to personally inspect puppy. Buyer may return puppy to seller for a full refund for any reason within this period, providing Buyer agrees to pay all return transportation costs to Hidden Cedars AKC Mini Dachshunds. After the 48 hours period the buyer is completely satisfied with and waives any and all claims regarding the Pups conformation and outward appearance. (means Puppy meets breed standard at this age) Puppy has been graded to be breeding quality. Breeding quality shall be understood to mean that no disqualifying cosmetic faults as defined in the AKC Dachshund standard are evident at time of sale and further that no faults of genetic origin are immediately apparent.
- Should Puppy develop any disqualifying faults as defined in the Standard, or be diagnosed with any genetically derived medical disorder which is confirmed by two unassociated veterinarians, thereby causing Buyer and Seller to agree that Puppy cannot ethically be bred, Seller will, upon provision of veterinary reports provide Buyer with one of the following options.
- a) Should Buyer choose to keep Puppy and accept refund, Seller will refund 50% of purchase price ($_____). Puppy must be spayed or neutered before refund check will be issued, and Buyer’s veterinarian of choice must provide spay/neuter certificate to Seller. b) Should Buyer choose to relinquish ownership of Puppy to Seller, Seller will refund purchase price less any shipping or miscellaneous charges necessary for transportation of Puppy to Seller. c) Should Buyer choose to keep Puppy and accept a replacement breed quality puppy, Buyer must pay pet price ($_____) and any shipping or miscellaneous charges associated with transport of replacement puppy. Upon receipt of spay/neuter certificate and $______ Seller will provide a replacement breed quality puppy as soon as such a puppy is available to Seller.
- Seller shall not be held responsible for the development of disqualifying faults, diseases, or disorders, which are due to Buyers negligence.
BREEDING
- 1. Buyer agrees that Puppy shall not be used for breeding purposes until the following certifications have been received by the Seller:
- AKC Championship acknowledgement
- It is agreed co-owner may breed this dog to bitches owned by and residing with him/her only. In such cases, no stud fee will be paid by the Co-owner to the breeder. It is agreed that Co-owner is not buying outside reproduction rights of dog. Breeder takes all financial risks and or gains for any outside breeding of this dog. If bred outside arrangements will be handled through Breeder. Final breeding decisions remain with the Breeder on any and all outside breeding. Breeder reserves the right to request service to her own bitches and Co-owner agrees to make dog available to breeder as/if needed at reasonable convenience to Co-owner.
- Puppy will not be spayed/neutered without written and verbal authorization between Co-owner and Co-owner/Breeder. It is assumed that this is a permanent home placement for this puppy.
- All pet puppies resulting from the breeding of this dog to co-owners bitches will be sold on a spay/neuter contract with limited registrations. Any intact show prospects will be sold only to fully screened or established, ethical buyers approved by Breeder of this dog.
HEALTH GUARANTEE
- Seller guarantees that Puppy is in good health and has received appropriate medical inoculations, worming and care. Seller will provide Buyer with a medical chart detailing treatment Puppy has received under Seller’s care, and any future care Seller feels is essential to Puppy’s well being.
- Seller guarantees that Puppy is free of life threatening diseases or disabilities for 48 hours after delivery to Buyer. Should life threatening diseases or disabilities be discovered by Buyer within 48 hours after receipt of Puppy, and attested to in writing to Seller by Buyer’s veterinarian, Seller will provide Buyer with a replacement breed quality puppy as soon as such a puppy is available to Seller, or refund 100% of purchase price ($_______). Seller strongly recommends that Buyer have Puppy examined by a licensed veterinarian of Buyers choice within 48 hours of receipt of Puppy.
- Buyer agrees to maintain Puppy in good health, provide routine preventative health care including, but not limited to the following: annual physical exams by a licensed veterinarian, annual vaccines, annual fecal exams, continual heartworm prevention and rabies vaccines as mandated by Buyer state and county of residence.
- Buyer further agrees to provide proper exercise as indicated in order to maintain Puppy in proper weight and physical shape. A proper diet consisting of top quality dog food shall be fed. Buyer agrees that Puppy shall not be left solely in a backyard or kennel and will be allowed to spend substantial quality time in the home with family members. Puppy is sold with the understanding that it was to go to carefully selected parties and the Buyer avows that the Puppy shall become a member of the family.
TEMPERAMENT
- Seller strongly recommends that Buyer attend obedience classes with Puppy and provide proper socialization opportunities for Puppy.
- Seller shall not be held responsible for acts of Puppy, which are due to Buyers negligence.
GENERAL
If it is reported and confirmed that Puppy is being abused or neglected by Buyer, rights and ownership of Puppy will automatically terminate and revert back to Seller who may immediately assume possession. Buyer agrees Seller will repossess puppy upon evidence of neglect and/or abuse and that Buyer will be responsible for Sellers fees and costs involved in repossession or breeding without approval.
- Buyer agrees to allow Seller the right of first refusal should Buyer decide to sell, relinquish or transfer Puppy at or below the original price. Such offer of first refusal will be given to Seller in writing, via certified mail. The Seller has five working days after receipt of written offer to exercise option. Any transfer back to Seller shall be accompanied with the appropriate AKC registration papers properly endorsed by Buyer. Buyer will not sell, give or otherwise transfer Puppy without first giving Seller right of First Refusal. Under NO circumstances shall Puppy be taken to an animal shelter, humane society or released to a Rescue group.
- Should Buyer choose to break any of the above portions of this agreement, the remainder of the agreement will be considered null and void, and Seller will have the right to repossess Puppy.
- Buyer and Seller agree that this Agreement will be governed by the laws of the State of Texas and may not be altered, modified or rescinded unless agreed to in writing by Buyer and Seller. If any provision of this document is invalid or unenforceable under applicable law, this document shall be ineffective to the extent of such invalidity only, without affecting the remaining portion.
4.Buyer agrees that Seller shall have the right to enforce provisions of this contract in a court of law or through alternative dispute mediation. If legal action by Seller is necessary to enforce any provision, Buyer will pay for costs and attorney fees incurred by Seller.
